Terms and Conditions – Profit Tracker

1. Agreement to Terms

By purchasing, downloading, installing, and using Profit Tracker software (“the Software”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Software.

Trucking Pro Software (“we,” “us,” “our,” or “Company”) provides Profit Tracker accounting software for owner-operators and small trucking businesses.

2. License Grant

Trucking Pro Software grants you a non-exclusive, non-transferable license to use Profit Tracker on a single Windows computer for personal or business use only.

You may:

  • Install and use the Software on one Windows computer
  • Create, store, and manage your trucking business data
  • Export your data at any time
  • Use the Software for your own trucking business operations

You may not:

  • Copy, modify, or create derivative works of the Software
  • Distribute, sell, or rent the Software to others
  • Use the Software on multiple computers without purchasing additional licenses
  • Reverse engineer, decompile, or attempt to discover the Software’s source code
  • Use the Software for any illegal purpose or in violation of any laws

3. Purchase and Payment

All sales are final. Payment must be completed through FastSpring, our authorized payment processor, before access to the Software is granted.

One-Time Purchase ($156):

  • You own the Software license forever
  • Includes one year of free updates and customer support
  • After one year, updates and support are optional ($56/year if desired)

Optional Maintenance Fee ($56/year):

  • Renew after year one to continue receiving updates and support
  • Not required to continue using the Software (it will run indefinitely)

4. Software Provided “As Is”

Profit Tracker is provided on an “as is” basis without warranties of any kind, express or implied. We do not warrant that the Software will be error-free, uninterrupted, or fit for any particular purpose.

Disclaimer of Warranties:

  • We make no warranty that the Software meets your requirements
  • We make no warranty that the Software will be compatible with all Windows versions
  • We make no warranty regarding the accuracy of calculations or reports generated
  • We do not warrant that data will be preserved or recoverable in all circumstances

5. Limitation of Liability

To the maximum extent permitted by law, Trucking Pro Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost revenue, arising out of or in connection with your use of the Software.

Our total liability to you under these terms shall not exceed the amount you paid for the Software ($156 or $56).

6. User Responsibilities

You are responsible for:

  • Maintaining regular backups of your data
  • Ensuring your Windows computer meets system requirements
  • Complying with all applicable laws when using the Software (including tax reporting requirements)
  • Keeping your license information confidential
  • Not sharing your license key with others
  • Properly securing your computer against viruses and malware

The Software is not responsible for data loss due to computer malfunction, virus infection, accidental deletion, or hardware failure.

7. Data Ownership and Privacy

Your data belongs to you. You own all information you create and store in Profit Tracker, including:

  • Load records
  • Expense entries
  • Fuel purchases
  • Maintenance logs
  • Financial reports

We do not:

  • Access your data without permission
  • Sell or share your data with third parties
  • Use your data for marketing purposes
  • Encrypt or control your data (it’s stored locally on your computer)

8. Updates and Support

Included with purchase (Year 1):

  • Free bug fixes and critical updates
  • Access to training videos
  • Email support for technical issues

After Year 1 (optional):

  • Pay $56/year to continue receiving updates and support
  • OR continue using the Software free without updates or support

9. System Requirements

Profit Tracker requires:

  • Windows 10 or Windows 11
  • Intel or AMD processor
  • Minimum 2GB RAM
  • Minimum 500MB available disk space
  • Internet connection (for licensing and updates only)

Not compatible with:

  • Mac (unless running Windows via VMware)
  • Linux
  • iOS/Android mobile devices
  • Chromebooks or tablets without Windows

10. Intellectual Property

Profit Tracker is proprietary software owned by Trucking Pro Software. All intellectual property rights are retained by us. Your license does not grant you any ownership rights in the Software.

11. Termination of License

Your license is valid for as long as you follow these terms. We may terminate your license if you:

  • Violate any provision of these Terms and Conditions
  • Use the Software for illegal purposes
  • Attempt to reverse engineer or modify the Software

Upon termination, you must cease using the Software and delete all copies from your computer.

12. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Continued use of the Software after changes means you accept the new terms.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of [Georgia/USA], without regard to its conflict of law provisions.
